Delegates Akers and Linville moved to amend the Committee Substitute on page 2, section 1r, line 18, immediately following the word “section” by inserting the following: “The codification of these standards, or the promulgation of these rules, shall not constitute a cause for which utilities may seek rate recovery for existing hydrants at the time of enactment of this section for which prior rate recovery was received. Rate recovery may occur for new hydrants, upgrades to the hydrant system and/or new construction relating to existing hydrants. If any portion of this section regarding rate recovery is deemed invalid or unenforceable, the remaining portions of this section shall still remain effective.”
